Conservatory Repair Company Terms and Conditions
Acceptance of order – New roofs and full replacement structures,
All contracts are excepted subject to a final site survey, If following the survey it is determined that the contract cannot be carried out by reason of its nature or incorrect pricing, the customer will be advised accordingly. The choice of cancellation or a revised quotation will be offered. The client can within five days of receiving a revised price cancel the contract by sending written notice to the company. In this situation any deposits paid will be refunded in full.
Delivery periods
All quoted times are estimated and the company will not accept liability for any situation caused by delays caused by situations out of its control such as adverse weather conditions. Or site conditions/obstructions that were impossible to plan for at survey (such as hidden services, drains etc.)
Insurance’s
The company will keep at all times full and comprehensive liability insurance
Payment
Full payment of moneys due as specified on the contract will be payable on final completion of the installation unless stage or deferred payment terms have been agreed beforehand.
Payment can be made by Cash, Personal cheque, BACS or Bankers order made payable to the company.
The client must retain a copy of the invoice showing receipt of payment.
Specification
Any Glass or framework samples are to demonstrate the typical composition of the product in question. Glass and/or framework will be measured and manufactured in the way considered suitable by the company. Pursuant to the companies policy of continuous improvement to its products and its services it reserves the right to make any necessary modifications as it sees fit. Further to this effect the Company may substitute a quoted material for one of documented higher quality or performance without any further notice or charge to the client.
Glass
All glass used will be of high quality, However the company will not be deemed liable for any minor blemishes, seeds or the phenomenon known as ‘brewsters fringe’ which can occur in glass in particular toughened safety glass during the manufacturing process. The company will also accept no liability for cracked or broken glass units that occur after installation has been completed. The company will comply with all current legislation regarding the usage of safety glass.
Installation
The customer shall grant the company’s employee’s access to the property at reasonable times for the purpose of site surveys and the carrying out of the required works. The company accepts no responsibility for damage caused by structural or other defects in the installation property. The customer shall be responsible for the removal of all internal fixtures and fittings that are deemed necessary for the repair/installation work to be carried out in full.
In the event that a customer insists against the company’s advice to install an oversize frame or glazed panel the company will not accept any liability for any risk or potential adverse consequences involved. The company’s guarantee will not apply to any defect, which is the result of the installation of said oversize unit.
Guarantee
Unless notified in writing all replacement components are guaranteed against failure for a period of ten years. The guarantee does not cover damage caused by misuse or excessive force, or repairs and adjustments carried out by any person other than the company or its accredited service agent.
Condensation
The company cannot guarantee that condensation, if any, can be reduced or eliminated by the installation of its products. Nor can it accept liability for condensation, which is a natural phenomenon caused by degrees of temperature, humidity and ventilation.
Limit of liability
The company will not be liable in contract tort or otherwise for any indirect or consequential damage of any nature whatsoever;
(a)The companies liability for loss or damage in contract tort otherwise in relation to this contract shall be limited to the price charged for the provision of goods and services.
Where the customer is a customer (as defined by the unfair contract terms act 1977) nothing in these conditions shall effect their statutory rights.
Retention of title
The company will retain sole ownership of any goods installed under the terms of this contract until payment has been made in full. It also reserves the right to amend or cancel any product guarantees if payment is not made as and when due.
Cancellation
The customer has the right to cancel the contract in writing within seven days from date of order with no cost to them, in this instance any deposits paid will be refunded in full.
Should cancellation occur after the initial period then the company will be entitled to charge the customer reasonable costs to cover any work carried out. If Manufacture has been commenced or completed the company will be entitled to charge the customer up to 85% of the contract value. Unless previously arranged the customer is responsible for the obtaining of any special licences, permits or local authority permissions required by law for the completion of this contract
